Terms of Service

1. About these terms

These terms govern your use of Every Single Session, or ESS. ESS is provided byBabylon Optima B.V., Aelbrechtskolk 45B, 3025 HB Rotterdam, the Netherlands, Chamber of Commerce number 91102421.

By creating an account or using ESS, you agree to these terms. If you do not agree, do not use the app. Mandatory consumer rights in your country continue to apply.

2. The service

ESS helps you organise routines, log workouts and review training progress. We may improve, change or remove features to develop the product, maintain security or comply with law. We will give reasonable notice if a material change adversely affects active users, where practical.

3. Your account

• You must be at least 16 years old and legally able to agree to these terms.
• Provide accurate account information and keep your credentials confidential.
• Tell us promptly if you suspect unauthorised access.
• You are responsible for activity performed through your account unless caused by our failure to protect the service.

4. Your data

You retain ownership of the content and training data you enter into ESS. You give us a limited licence to host, process and display that data only as needed to provide, secure and improve the service.

You can export completed workout data and delete your account in the app. Our Privacy Policy explains how personal data is handled.

5. Acceptable use

You may not:

• use ESS unlawfully or to infringe another person's rights;
• attempt to access another account or data without permission;
• interfere with security, availability or normal operation;
• upload malicious code or use automated tools to overload or scrape the service;
• resell, copy or reverse engineer ESS except where applicable law expressly permits it.

6. Health and fitness notice

ESS is a record-keeping tool, not a medical device and not a substitute for medical or professional fitness advice. Estimates, warm-up guidance, statistics and other output may be incomplete or unsuitable for your circumstances. Consult a qualified professional when appropriate, train within your abilities and stop if you feel pain or unwell.

7. Intellectual property

ESS, its software, design, brand, text and other materials are owned by Babylon Optima B.V. or its licensors and are protected by intellectual-property law. These terms grant only a personal, limited, non-exclusive, non-transferable right to use the app.

8. Availability and warranties

We aim to keep ESS reliable, but internet services can be interrupted and errors can occur. To the extent permitted by law, ESS is provided as available and without warranties beyond those that cannot legally be excluded. Keep your own export of training data when uninterrupted access is important to you.

9. Liability

Nothing in these terms excludes liability that cannot legally be excluded, including liability for intent, fraud or death or personal injury caused by negligence where applicable. Subject to that, Babylon Optima B.V. is not liable for indirect or consequential loss, lost opportunities or loss caused by using ESS contrary to these terms or fitness guidance.

10. Suspension and termination

You may stop using ESS and delete your account at any time. We may suspend or end access if you materially breach these terms, create a security risk or if continued service is unlawful. Where appropriate, we will explain the reason and give you a chance to remedy the issue.

11. App-store terms

If you download ESS through Apple's App Store, Apple is not responsible for ESS or its support. Your use is also subject to applicable App Store terms. These terms are between you and Babylon Optima B.V., not Apple.

12. Governing law and changes

Dutch law governs these terms. If you are a consumer, mandatory law and the courts available to you in your country remain unaffected. We may update these terms for legal, security or product reasons and will communicate material changes appropriately.
